Council Members Express Concern Over Election Administrator's Appointment

The Scene says the letter expressing concern over the Election Administrator's Appointment is bipartisan. It is worth nothing who the six are that signed the letter:  Lonnell Matthews, Brady Banks, Anthony Davis, Edith Taylor Langster, Karen Johnson and Robert Duvall.

Only one of six who signed that letter is a Republican. However, he is an important Republican. Robert Duvall is the Chairman of the Davidson County Republican Party.

I would have been very concerned if a Republican would not have gotten the appointment. This system is designed so that whichever party controls the State House controls the election commission in every county in the State. The Commission should have chosen a Republican. However, I was concerned about the particular Republican chosen. I explained by concern in this post: Update : 10-29-2013- As expected the Davidson County Election Commission selected Kent Wall as Election Administrator yesterday. 

I was concerned because it may appear that the Davidson County Republican Women are controlling the Election Commission. The newly appointed Davidson County Election Commission Administrator, Kent Wall, is the husband of Susan Wall who is Chair of the Davidson County Republican Women and Ron Buchanan, Chairman of the Commission, is the husband of Vicki Buchanan, a Vice Chair of the Davidson County Republican Women. That relationship just appears too cozy.

Dr. Jason Robinson: I could not with a clear conscience agree to place some of the materials presented to us in the hands of my children or any other student in our state.

Below is the statement of Dr. Jason Robinson of the state textbook commission delivered at the October 23rd meeting of the commission. He was one of the "no" votes, voting against approving the list of social studies text books. I feel that his statement is important enough to be printed in full. I copied this statement from the website of Tennessee Eagle Forum

Statement of Dr. Jason Robinson:

First of all, let me thank you all for your hard work and dedication in this process. I also want to say that I have a great amount of respect for each of the commissioners seated with me. There is not one person up here who doesn’t want the very best for our students. In addition, I would like to thank Mr. Branch, Ms. Barton, Ms. Shelton, Ms. Jones, and the other folks from the Department of Education. I want to thank you for your support and for not pressuring this commission in any way. You have shown us nothing but respect. Finally, I would like to thank each person in the audience for your dedication to our kids.

For the past several months, we have taken a great amount of time looking at social studies textbooks, listening to concerned citizens, examining reviewer comments, and hearing presentations from textbook companies. And we have researched information on our own.

As one of the newer members of this commission, I had no idea of the responsibilities and weight that I would feel when I was appointed to this panel, but I do not believe it is by accident that we are here. When talking about the responsibility that we have in the textbook adoption process, I was told that we, the commission, make sure that the books cover the state standards. It is not our job to look at biases or inaccuracies but just to decide on a list of textbooks that are standards based. Local school systems ultimately decide whether textbooks are biased and inaccurate. If they don’t like the books, they shouldn’t buy them. The power to select textbooks is truly in their hands. 


Teachers also play a big part in what is being taught in the classroom. As a former public school science teacher, I understood that textbooks were simply a source of information. In no way did they direct my instruction. I, as the teacher, had a great amount of influence over the fine details that were covered in my classroom and the way I answered and presented material. Parents also play a big part in the information that children are presented. Over the last two years my wife and I have had several conversations with our high school and middle school aged children regarding inaccurate information that was presented in a classroom. It was information that contradicted the personal beliefs and values we embrace as a family. The information was not contained in a textbook but was nothing more than one teacher’s political and social opinion. It was our job as parents to step up to the plate and correct a wrong.

And we did that.

When I served in the public schools, I had the opportunity to serve on several textbook selection committees for Bradley County Schools.  We believed wholeheartedly that if a textbook was on the state’s approved list, it was high quality, unbiased, and accurate. At no time did we ever examine the textbooks to check for those items. Instead, we looked at how colorful the photos were, what kind of technology perks we would be given, and how many consumable items would be included with the adoptions. I know for a fact that many educators have no idea that textbooks on the state’s approved list may still contain details that may be considered inaccurate or biased. How did some materials make their way into the classrooms the last adoption cycle? They made their way into those classrooms because that school system purchased the books…..the books that educators believed contained accurate unbiased information because they were on the approved list.

As a member of this commission, I believe it is my job to do all I can to make sure that every single child from every different background, religion, ethnicity, or socio-economic standing, has the highest quality textbooks available to them. We have been presented some books that contained inaccurate information, vulgar language, inappropriate cartoons, possible social and political agendas, and potential religious bias. We have been told that certain scenarios are acceptable because there were in advanced level textbooks. In my opinion, that is ridiculous. I believe the textbooks should cover the standards. There is one standard that I believe some of the textbook companies have forgotten and that is a standard of excellence that every child in our state deserves, no matter what their belief or background is. My opinion is personal. I am a father, an educator, and a member of this commission.

 I spent a great amount of time looking through reviewer comments, public comments, emails, and research, and I couldn’t believe how many corrections had to be requested from certain textbook companies. If they had done it right the first time, we wouldn’t be in the situation we are in today. Yes, they have corrected some of the information requested, but they shouldn’t have had to, definitely not to the degree necessary.  If there are any textbook companies represented in this room today, I would be embarrassed and ashamed by the concerns some of your companies have caused.  If the individuals who wrote the material contained in some of your textbooks are the best you could find, you probably ought to start from scratch and hire some new writers. Just present accurate facts, and let the students and families form their own opinions. They don’t need your help, just the facts. That, in my opinion, is an education.

As a commission member I want you to know that my decision is not based on public opinion or the opinion of any individual, political, or government entity. It is an educated opinion that I have made by looking at the details contained in the textbooks and from all of the information presented. The name says it all - APPROVED TEXTBOOK LIST. For me to agree says I personally approve of every textbook we have been presented, I cannot do that, and I believe our elected officials with whom we met this summer at Legislative Plaza on both sides of the aisle would agree with me.  I could not with a clear conscience agree to place some of the materials presented to us in the hands of my children or any other student in our state.

For that reason, I will be voting “NO” to the list as it is presented.

Textbook Commission approves textbook list by 3-2 vote! One book removed.

In Tennessee, a 10-member textbook selection panel is charged with reviewing text books and recommending a list of  selections to the State Board of Education. The State Board of Education then approves the list and local school systems then choose which textbooks to adopt from the official state textbook list.

In the past, this has been a process that received scant attention and by most accounts was pretty superficial. For one thing, due to time restraints there was no way the members of the textbook selection panel could actually read all the textbooks they considered. Earlier this year, some parents and citizen activist started paying attention to what textbooks are being used in our schools and found some to which they objected and started reading the text books and letting there opposition be know. In response to public pressure, on October 7th when the textbook Commission met they refused to even make a motion to accept a list of  Social Studies textbooks.  When they met on October 23rd only five members were present and the list of social studies text books were approved by a vote of three to two after one book was removed from the list. 

While some of the activist were disappointed that the list was approved, I would think this is a tremendous victory. For the first time people are paying attention to the selection of textbooks, one book was removed, the 3-2 vote is a close vote, and instead of just routinely approving a list of books, the text book panel actually carefully considering their actions. This is a great start!

TNGOP Chair Chris Devaney on Secretary Sebelius' Memphis Visit

NASHVILLE, Tenn.- Health and Human Services Secretary Kathleen Sebelius is taking a page from President Obama's book and traveling the country to peddle bad policy instead of trying to fix the problems which have plagued Obama Care and the Healthcare.gov website since its launch on October 1st. Two days after telling Tennessee Congressman Marsha Blackburn to "hold me accountable for the debacle," and "I'm committed to earning your confidence back by fixing the site," during a Congressional hearing, Sebelius will be at the Benjamin L. Hooks Central Library in Memphis today to talk about the Affordable Care Act.

"Unless she is there to check out a book about website development, then we can expect more excuses and misinformation from this administration," said Tennessee Republican Party Chairman Chris Devaney. "In Washington we have President Obama trying to defend his deceitful insurance sales pitch of 'if you like it you can keep it,' while Sebelius and HHS try to explain the debacle that is healthcare.gov."

"The whole thing looks like a snake oil medicine show being orchestrated from the White House. Unfortunately for President Obama and Secretary Sebelius the bad policy the administration is trying to peddle continues to develop more symptoms of its impending failure than a cure for what ails it," concluded Devaney.

Forbes: 93 Million Americans Will Be Unable To Keep Their Health Plans Under Obamacare

According to Forbes magazine, 51% of Americans will lose there employer based insurance. Obama knew this as early as 2010. There is no nice way to say it; Obama is a damn lair.

Judson Phillips says it is time to end the war on drugs. His solution is no solution.

Judson Phillips, the founder of Tea Party Nation and an early leader in establishing the Nashville tea party movement, is now a columnist with The Washington Times. In his WT column last Friday he argues that it is time to end the war on drugs. I could not agree more. Phillips lays out how the war on drugs as been a failure and the ill effects it has created and the unintended consequences of this failed policy:

Today it consumes billions of dollars. It has created a law enforcement profit industry, where law enforcement can take money and property away from innocent people. These people, who are frequently not even charged with a crime, are forced to go to court, if they can afford a lawyer, and they are forced to prove their property is lawfully theirs.
The war on drugs has incarcerated tens of thousands of people whose only crime was a drug offense. It has created Mexican drug cartels that terrorize not only Mexico but are now reaching into the United States. These cartels reap huge profits from illegal drugs.
Phillips goes on to argue however that in replacing the War on Drugs, we should regulate drugs and users. He proposes that those who want to use drugs should have to register with the government and they would be prohibited form working in certain occupations and would be prohibited from using public assistance programs. He says, "The the penalties for possession of drugs by an unregistered user should be draconian."

I am afraid what Phillips is proposing is no solution at all. There are a lot of causal and occasional users of marijuana. Does one seriously think these people would register with the government? I know I wouldn't, (if I was a user). There are a lot of users of pot who may only occasionally smoke at parties or with close friends. These users are more like social drinkers. They are not going to register as drug users. There are also users who may smoke a little dope now and then in the privacy of their home. They may get a little buzz a few times a week but they smoke small quantities and a little may last them for months. Does anyone think these people will register with the government and get their drug-user permit? I think very few user of pot, the most prevalent illegal drug, would register?

Maybe registering  heroin addicts has some merit, but I doubt it would work with other drugs. His proposal would not end the war on drugs because to continue draconian measures for non registered users is to continue the war on drugs.

I think we should partially decriminalize pot immediately. No one should be imprisoned for possession of small amounts. Then, we should regulate it, perhaps following the pattern of Amsterdam, or perhaps taxing it and regulating it  much like we do alcohol. I am not coming from an absolutist libertarian position on this issue, but a more pragmatic view. Pot is relatively harmless. It is less harmful than alcohol by far, both as a social problem and a health problem. People should not be criminals for using it. Prohibition of marijuana has not worked. This does not mean that I think meth or heroin or all other drugs should be legalized. We need to decide the best policy with regards to crack and power cocaine. Should those two forms of the same drug be treated so differently?  This, and the policy on other drugs should be examined, but decriminalizing pot is a good place to start. If we end the war on pot, we have ended about 90% of the war on drugs.

I am glad to see Justin Phillips recognize that, "The drug war has been a total disaster on every front." I am afraid however, that his proposal is not an improvement and would not end that war.

Update: It is Kent Wall. Election Administrator to be selected at Davidson County Special Called Meeting 10/28/2013 3:00 PM

Update : 10-29-2013- As expected the Davidson County Election Commission selected Kent Wall as Election Administrator yesterday.

On Monday Oct. 28th the Davidson County Election Commission will select a new Election Administrator. The position of Election Administrator became vacant in May after the newly appointed Election Commission fired Election Administrator Albert Tieche. 

The four nominees for the position are:
  • Joan Nixon, a 28-year career employee of the Election Commission and a Democrat who is currently serving as interim administrator. She was appointed to the position after Albert Tieche was fired.
  • Steven Murff, former program director of the Davidson County Mental Health Court.
  • John Howell, who works in the Nashville hospitality industry.
  • Kent Wall, an election poll worker volunteer and former president of Johnston & Murphy, a subsidiary of the Genesco footwear company. 
Sources tell me that Kent Wall is the favored candidate of Election Commission Chairman Ron Buchanan and the person likely to get the job. Some people have raised eyebrows about the close relationship between the Walls and Buchanans. Kent Wall's wife is Susan Wall, Chair of the Nashville Republican Women's Club and Ron Buchanan's wife is Vicky Buchanan, a Vice Chair of the Nashville Republican Women's Club. I am not sure that there is anything particularly wrong with that. The Election Commissioners are political appointees and one would expect them to be active in party politics and often spouses of people who are active in politics are also involved in politics, however it may appear a little too cozy. For appearances sake it might be appropriate for Ms Wall and Ms Buchanan to resign their positions with the Nashville Republican Women. On the other hand, if Mr. Kent does get the position and all goes smoothly at the Election Commission no one will care, but should their be problems we could expect the press and Democrat activist to try make something of the fact of this close relationship.

I have been told that at the last Commission meeting when candidates were being interviewed for the position of Election Administrator that Chairman Ron Buchanan aggressively questioned John Howell. I was not there so I don't know what occurred, but I heard this from more than one source. One person told me, he treated Howell worse than he did Albert Tieche at the meeting where Tieche was fired. Another person told me that Buchanan treated Howell like a witness on cross examination. If anyone was present at that meeting, I would welcome you leaving a comment to confirm or refute this.

Whoever is appointed Election Administrator, I hope they do a good job and stay out of the news. That may be hard to do however. With Tennessee a Red state except for the Blue strongholds of Memphis and Nashville, Democrats are going to do all than can do to hold on to power. They can be expected to go after the next Election Administrator the same way they went after Tieche. Tieche had an especially challenging job to do. He had several election in a brief period of time, he faced a redistricting and the introduction of new technologies. Also he was the first Election Administrator appointed by a Republican majority Election Commission and he inherited a staff that were all Democrats. The next Election Administrator may not have as many challenges as did Tieche but Democrats can also be expected to make his life difficult and to use ever opportunity to promote an agenda that claims Republicans are trying to disenfranchise voters. Whoever the new Election Administrator is, he will have his work cut out for him.
